These terms govern your use of the CueRise mobile application ("CueRise", "the app"), operated by [COMPANY NAME], a company registered in England and Wales ([COMPANY NUMBER]), registered office [REGISTERED ADDRESS] ("we", "us", "our").
By downloading or using CueRise you agree to these terms. If you do not agree, please do not use the app.
1. What CueRise is — and what it is not
CueRise is a wellbeing and personal-development app. It offers short daily routines combining breathing exercises, light physical movement, and reflective journaling, together with an AI coaching feature.
CueRise is not medical care. It is not a medical device, and it does not provide medical, clinical, psychological, or therapeutic services. It does not diagnose, treat, cure, or prevent any condition. Malou, the AI coach, is not a therapist, counsellor, or medical professional.
Nothing in the app is a substitute for advice from a qualified professional. If you have concerns about your physical or mental health, please consult a GP or an appropriate professional.
If you are in crisis, please contact emergency services or a crisis line. In the UK, Samaritans are available free on 116 123, at any time. In an emergency, call 999.
2. Physical activity
Some practices involve light physical movement or breathing techniques. You are responsible for exercising your own judgement about what is safe for you. Stop if you feel unwell, and consult a doctor before starting if you have any medical condition, are pregnant, or have any reason to believe physical activity or breathwork may not be appropriate for you.
You take part in these practices at your own risk.
3. Eligibility
You must be at least 13 years old to use CueRise. If you are under 18, you should have your parent or guardian's permission.
4. Your content
Journal entries, moods, and other content you create remain yours. Most of this is stored only on your device — see our Privacy Policy for detail on what is transmitted and when.
You are responsible for the content you enter. Do not enter content that is unlawful or that infringes someone else's rights.
5. The AI coaching feature
Malou generates responses automatically. Responses may occasionally be inaccurate, incomplete, or unhelpful. They are not professional advice and should not be relied upon as such. Use your own judgement.
We may apply usage limits to the coaching feature. Current limits are shown in the app.
6. Subscriptions and payment
CueRise offers optional auto-renewing subscriptions.
- Payment is charged to your Apple ID account at confirmation of purchase.
- Your subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your account is charged for renewal within 24 hours prior to the end of the current period, at the price of the plan you selected.
- You can manage and cancel your subscription in your Apple ID account settings.
- Any unused portion of a free trial period, where offered, is forfeited when you purchase a subscription.
Prices are shown in the app before purchase and may change. Any change will apply from your next renewal, not the current period.
Purchases are processed by Apple. Refunds are handled by Apple under their terms — we cannot issue refunds directly. You can request a refund through Apple Support.
7. Availability
We aim to keep CueRise available and working, but we do not guarantee uninterrupted service. Features that rely on internet connectivity — including the AI coach and weekly reflection — may be unavailable at times.
We may change, suspend, or discontinue features. Where a change materially reduces what you have paid for, we will act reasonably and in accordance with your rights under consumer law.
8. Our intellectual property
The app, its content, design, and the CueRise and Malou names and branding are owned by us or our licensors. You may use the app for your own personal, non-commercial use. You may not copy, redistribute, reverse-engineer, or create derivative works from it, except where the law permits.
9. Acceptable use
Do not use CueRise to break the law, attempt to gain unauthorised access to our systems, interfere with the app's operation, or misuse the AI coaching feature (for example by attempting to extract system instructions or generate harmful content).
We may suspend access where these terms are breached.
10. Liability
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.
Subject to that, and to the extent permitted by law:
- CueRise is provided on an "as is" basis.
- We are not liable for any decision you make based on the app's content or on responses generated by the AI coach.
- We are not liable for loss of data stored on your device, including where you delete the app. Your on-device data is not backed up by us and cannot be recovered by us.
- We are not liable for indirect or consequential loss.
If you are a consumer, you have statutory rights that these terms do not affect.
11. Ending your use
You may stop using CueRise at any time by deleting the app. Deleting the app permanently removes data stored on your device. Cancelling a subscription is done through your Apple ID settings.
We may end or suspend your access if you materially breach these terms.
12. Changes to these terms
We may update these terms. Material changes will be notified in the app. The "last updated" date shows the current version. Continuing to use CueRise after a change means you accept the updated terms.
13. Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer resident elsewhere in the UK, you may also bring proceedings in your local courts.
